The Court held the starting point of 16 years 10 months for 475g cocaine narcotic was within guidelines, the judge erred in not enhancing the sentence for the applicant's Form 8 recognizance status (an enhancement of up to 18 months would have been appropriate), and the reduction of the guilty plea discount to approximately 30% was justified by the unmeritorious contest and delay; the leave application was withdrawn and the appeal dismissed.
