The court held that the Small Claims Tribunal erred in treating the settlement agreement as invalid because unfulfilled conditions allegedly attaching to credit notes did not impeach the settlement agreement; the existence of the settlement agreement was a factual finding which could not be displaced and the cleared payment of the agreed balance supported enforcement of the set-off in the agreement, therefore the Tribunal's awards were quashed.
