The Court of Appeal held that To J should have recused himself because his considered and repeated written findings that opposing counsel had deliberately attempted to mislead the court were of such gravity that a fair-minded and informed observer would conclude there was a real possibility of bias; accordingly parts of To J's orders relating to the recusal, discharge and strike-out applications were set aside and those summonses remitted to another judge.
