Because the High Court judgment had been entered and the action had merged into that judgment, section 40 authorized transfer of the action not the judgment; section 44(2) preserves the plaintiff's right to enforce the High Court judgment in the High Court. Therefore the transfer to District Court could not oust the plaintiff's right to enforce the existing High Court judgment and the action was ordered returned to the High Court.
