The appeal was dismissed and the Registrar's order permitting examination of the witness in Canada was upheld because the witness had stated he would not come to Hong Kong, there was no evidence he could be induced to attend, and preventing the examination would effectively deprive the defendant of his right to defend; the applicant need not prove more than that the witness will not reasonably be expected to come where the facts support that conclusion.
