The annexed assignment and floor plans showed the first-floor unit and roof coloured to include the two flights of stairs and landing (areas of 59.09 sqm), and no colouring was applied to the ground-floor stairs (56.04 sqm); therefore the disputed staircases were part of the first-floor owner's exclusive property, so the respondent could not be compelled to remove the door/gate/wall and the applicant's claim on that point must be dismissed.
