The ex parte injunction was an abuse of process because there was no adequate justification for secrecy or urgency and the defendant should have been given notice; accordingly, had the injunction not already been spent the court would have set it aside. Nevertheless, on the merits there remained a serious issue to be tried as to exclusivity under clause 1(c) and possible absence of good faith by the defendant, and damages may be an inadequate remedy for loss of a chance to obtain equity.
