Given the deceased executrix had died, the executor of her estate was uncertain, interested parties who were served did not appear, and there was a real conflict of interest rendering the plaintiff unsuitable, it was necessary and convenient under s36 to appoint a professional independent administrator; accordingly Miss Fiona Chan was appointed.
