The Court of Appeal held that the Deputy Director's reference to available family support did not present an objectively ascertainable fact that was plainly or unassailably wrong; therefore the applicants' applications for discovery and further evidence were rightly refused and cross‑examination would have improperly invited the court to decide contested factual issues and usurp the administrative function. Consequently the Director's appeal is allowed and the family's appeals dismissed.
