    The taxing master found the majority of the expert fees and disbursements were properly and reasonably incurred and within the scope and caps of the agreed engagement letters and therefore allowed them; two items were outside the retainer and were wholly disallowed—professional fees for translating the report into Chinese (item 1257, HK$50,000) and fees for reviewing prosecution witness transcripts (item 1438, HK$72,000)—total disallowance HK$122,000; costs of the review were awarded to the claimant, taxed if not agreed, with certificate for counsel.

    The review was dismissed because the expert's higher rates and additional time were not justified under legal aid and party-and-party taxation principles: the taxing master had already allowed HKD 6,000 per hour for the expert based on the evidence, there was no proof of actual loss of income or exceptional overheads to justify higher rates, contemporaneous records and the nature of the reports justified the time allowed, and claimed trial preparation was premature; accordingly the original deductions were upheld and costs were ordered against the Plaintiff.

    Section 119R of the Landlord and Tenant (Consolidation) Ordinance prohibits making a costs order against a party in proceedings under Part IV unless that party conducted the case frivolously or vexatiously; the applicant did not so conduct her case, therefore the tribunal must maintain its no order as to costs and dismiss the respondent's review seeking to apportion the respondent's surveyor's fees to the applicant.
