The appellate court upheld the trial judge's credibility findings that the customs officers' evidence was consistent and reliable, the appellant's accounts were inconsistent and self‑contradictory (including his own complaint email), and therefore the prosecution proved beyond reasonable doubt that the milk powder was seized from the appellant and the conviction was safe.

The High Court dismissed the sentence appeal: the trial judge did not err in principle or impose a manifestly excessive sentence; the fine of HK$3,700 fell within established local sentencing practice and deterrence requirements; and the forfeiture of all six tins was lawful under statutory forfeiture powers and binding authorities, so the sentence and confiscation were confirmed.

The court had jurisdiction because the magistrate effectively refused the review on 31 May triggering s.104(10) and the appeal was filed in time; on the facts proved (loading, tow to Ma Wan, transfer to speedboat near the PRC boundary, radar tracking, appellants' presence and admissions) the magistrate was entitled to infer a single overall agreement to export the television sets without a licence and therefore the convictions for conspiracy were upheld.
