The Court held the Magistrate was entitled to reject the appellant's evidence on the balance of probabilities, that the Commissioner need only prove the articles were liable to forfeiture under Cap.60 s.27(1), that prior dismissals after offers of no evidence do not bind a forfeiture hearing, and that there was no material irregularity in the Magistrate's procedure; accordingly unconditional forfeiture was proper and the appeal is dismissed.
