The Court held the trial judge was entitled to prefer the defendant’s evidence that there was an express common intention that Delya Property be held with beneficial interest for the defendant as joint tenant and to find no express agreement to share Flat 1C; on Flat 1C the plaintiff's contribution (15.3%) gave rise to a resulting trust in that proportion; credibility‑based factual findings were not plainly wrong and the appeal was dismissed.
