The canopies, when extended and as affixed to external walls, constituted projections extending outside the exterior of Tower 4 and therefore breached clause B1 of the Deed of Mutual Covenant; the trial judge's findings that the canopies did not alter the external appearance of the Towers (clause B2) and that clause B9 was not breached were not disturbed; fresh evidence was inadmissible.
