Because the Land Registry record contained a remark of a mortgage in favour of the named encumbrancer and the encumbrancer could not be located or identified, section 12A applied; the plaintiff showed due diligence; the court therefore granted leave to pay $65 into court on account of principal and interest and allowed the proceedings to continue on an ex parte basis to the next stage with liberty to apply for a declaration freeing the property upon payment.
