If a defendant advances a version of facts relevant to sentencing that is not inherently incredible the sentencing court must resolve the dispute by allowing challenge to the prosecution account and the defendant to give evidence; absent that procedure the court must not impose a stiffer sentence based on the untested prosecution version or on the defendant's asserted court conduct.
