Because the learned Magistrate unjustifiably refused the defence application to recall the complainant for further cross-examination in circumstances where the appellant was unrepresented, suffered early-onset Alzheimer’s, and the case required forensic cross-examination on material issues, the conviction was unsafe; the appeal was allowed and the convictions and sentences were quashed.
