The Court refused leave to appeal against sentence, holding that although the trial judge was mistaken to suggest Durup established a tariff and erred in referring to an uncited higher authority, she was entitled to have regard to this Court's dicta (notably Ching Wai-Fan Carina) indicating harsher treatment for such offences; the starting point of four years and reduction to 2.5 years on counts 3–6 (and one month on count 2) after mitigation was not manifestly excessive nor wrong in principle.
