The magistrate's sentencing approach was lawful and appropriate: the sentences for overstaying and for false representations were within proper sentencing ranges, the guilty plea justified reductions applied, and activation of part of the prior suspended sentence was proper and necessary; therefore the appeal is dismissed.

The appeal was allowed and the sentence substituted because, although the offences were serious, there were strong mitigating factors—notably the appellant's exploitation by a pimp, lack of awareness of the offence's gravity, her personal circumstances and time already served—which justified reducing the effective sentence to one permitting immediate release.

The trial judge was wrong in principle by failing to adequately reflect the lesser culpability of the applicant compared with the co-defendant; appellate court reduced the applicant's overall sentence to three years and substituted three years imprisonment for the 3.5 year sentences on specified counts to reflect that difference.
