The appellate court dismissed the appeal because the trial judge's factual findings — that the masked man on CCTV was the appellant and that the reported abduction did not occur — were properly based on admissible identification evidence, corroborative physical items and credible medical and police evidence, and the cumulative evidence proved the offence beyond reasonable doubt so the conviction was not unsafe.

The magistrate was entitled to make a hospital order under s45(1)(a)(iii) based on medical reports; however appellate court may reduce the duration where, after weighing medical recommendations, public safety and the appellant's circumstances (including his apparent understanding of his condition and plea), a shorter period is proportionate. Accordingly the original 3‑month order was reduced to 2.5 months.
