Where a family home is purchased in joint names without an express declaration of beneficial interests, the presumption is equal beneficial ownership; that presumption can be displaced only by evidence of a common intention (including a later-formed common intention), and a later change requires clear evidence of an agreement by the original beneficial owner to surrender part of his or her interest.
