The court found that the pawnbroker (Shun Fat) failed to exercise reasonable care by not making sufficient enquiries despite circumstances that ought to have aroused suspicion (three pawns by a domestic helper within four weeks for items of substantial value); that failure caused or contributed to the unlawful pawning under s.23(3); accordingly the court ordered delivery of the gold items to the owner (Yuen) without payment and apportioned costs against the pawnbroker.
