The Court exercised its discretion to grant an unconditional stay of execution because the Defendants demonstrated strong grounds of appeal—notably that the judge erred in admitting a nominee-based restitution case and in entertaining fault-based disgorgement claims which were excluded by the CFA remitter—and on balance the risk of injustice justified staying execution pending appeal.
