The Court allowed the Law Society's appeal, concluding the Tribunal was plainly wrong to dismiss the complaints. On the cumulative documentary evidence and sequence of events (fictitious pleaded loan, consent judgment, rapid subsequent advance and deductions, charging order and enforcement steps, inconsistent documentation and conduct of the respondent) the inference that the respondent knew the first loan was fictitious was irresistible and proved beyond reasonable doubt.
