The Order refusing directions to make security for costs was procedural and did not by itself determine the plaintiffs' substantive rights for the purposes of Order 59 r21(1)(a) and s14AA HCO; accordingly leave to appeal was required but is refused because the proposed grounds lack reasonable prospects of success and do not raise an important new question of constitutional law, and the judge did not misapply the law or err in exercise of discretion.
