The Court of Appeal held that the District Court judge erred in treating a section 10 ECO hearing as interlocutory; section 10 hearings are final and require resolution of the substantive issues (including employment relationship) at that hearing, and because the judge proceeded on the incorrect assumption the hearing was interlocutory the decision below was set aside.
