The Court held that the Notices of Motion seeking leave to appeal were dismissed because (1) decisions refusing leave to appeal are not appealable under s14AB HCO and the constitutional challenge exception did not apply where the challenge was not to the finality provision itself; (2) the underlying decisions were properly characterized as interlocutory and s14(5) bars appeals on interlocutory status; consequently the appeals in CACV 192 and 193 were incompetent and struck out; there was no breach of the judicial duty under Basic Law art 104 as judges applied the law impartially.
