YUNG HUNG SZE v. SAH YEE

    Citation
YUNG HUNG SZE v. SAH YEE
    Court
    Court of Appeal
    Case number
    CACV197/1989

The Court of Appeal dismissed the appeal, holding that Judge Chism did not misdirect himself: he properly considered the father's understanding of the 1986 order but recognised that a consent order cannot oust statutory jurisdiction, and he took into account the parties' means (including the father's debts and the expected increase in the mother's disability allowance) in exercising his discretion to fix reasonable maintenance; there was no basis to disturb the maintenance order.
