The wife demonstrated a real risk of financial prejudice if the decree absolute were made now (loss of interim remedies, risk on death, inability to pursue proprietary or maintenance pending suit claims) and the husband offered no undertakings to protect her; applying the test in JAH v VH the court refused to make the decree absolute and dismissed the husband's summons.

The application for a stay of execution was refused because the defendant failed to show good prospects of success or exceptional circumstances supported by evidence that execution would frustrate appellate relief; financial ruin alone is insufficient and granting a stay would unjustly deprive the plaintiff of the judgment debt.

The appeal was dismissed because the appellant failed to prove, on the balance of probabilities, that any alleged inordinate and inexcusable delay by the plaintiffs caused serious financial prejudice to the defendant (there was no demonstrated causal nexus that judgment would have been obtained before the reinsurers' liquidations); therefore dismissal for want of prosecution was not justified.
