Conviction was quashed because the information alleged the bars were the property of "a person unknown", which materially misled the appellant and caused him to make procedural elections; a conviction cannot stand where the basis of conviction was not the case the defendant was required to meet and the information was not amended at trial; although the magistrate was legally correct in finding theft from the employer on the evidence, the defective information rendered the conviction unsafe and no retrial was ordered.
