The fine of HK$4,000 was manifestly excessive given the appellant was a first offender, the value of the stolen item was about HK$500, and the appellant's financial means (monthly social assistance ~HK$3,000); the sentence was therefore reduced to HK$2,000.

Although immediate custody was justified given the substantial sum and nature of the attempt, the magistrate failed to explain why a deterrent sentence was required for a first offender; in light of the appellant's clear record, amateurish conduct, absence of evidence he removed the cheque or forged the signature, and other mitigating factors, a reduced custodial sentence of six months was adequate.

The magistrate erred by imposing immediate custodial sentences without considering a Community Service Order after psychiatric reports showed no mental illness; the appellant met the criteria for a CSO under the guiding authorities, so the custodial sentences were quashed and replaced with a 160-hour CSO to be completed within 12 months subject to specified conditions.

Magistrates must consider alternatives to immediate custody for first offenders and should not insist on a notice of appeal before considering bail; bail pending appeal remains discretionary but refusal requires strong grounds where the sentence is short; accordingly the appellant, unjustly treated and having served nine days, should be regarded as having served sufficient custody such that the sentence is reduced to time served.

Although the magistrate's immediate custodial sentence was supportable on the material before him, the appellate court allowed the appeal because the newly produced character references and the severe personal and vocational consequences of imprisonment for the appellant demonstrated exceptional circumstances in a first offender with an early guilty plea, justifying substitution of a fine for imprisonment.
