The Court has jurisdiction to order costs in respect of motions taken within existing appeals; s.17 grants the Court a broad discretion to make any costs order it thinks fit and s.43 requires taxation only where the Court orders costs of the former kind (to be taxed), not where the Court awards a fixed sum. Applying that discretion, the Court ordered costs against Mr Scott in a fixed sum of $39,206.
