The application to adduce fresh evidence was refused because the Company either knew or could with reasonable diligence have discovered the Assignment before the winding-up order and the evidence would not have had the requisite effect; accordingly the appeal, which depended on that fresh evidence, failed and the winding-up order was upheld with indemnity costs to the Petitioner.
