The judge found on credibility that no contract was concluded for sale of the 'Feng' bird on 18 December 1991; the Yen 20,000,000 was paid as refundable earnest money; defendant's evidence was discredited by inconsistencies and a backdated invoice; accordingly the plaintiff was entitled to repayment of Yen 20,000,000, interest at 6.5% from 27 December 1991 and costs, and the court could give judgment in Japanese yen.
