The Court exercised its residual discretion to deal with the enforcement application summarily under Order 14 and Order 14A because the Russian judgment was final and conclusive and its factual findings were res judicata, there were no identified substantive factual disputes, and the defendant failed to articulate or prove an arguable foreign-law issue or other defence that would require a full trial or expert evidence; accordingly the preliminary contention that enforcement would offend the bar on enforcing foreign penal/revenue law was rejected at this stage.
