The absence of fingerprint or DNA evidence in this case was a neutral factor, the trial judge properly assessed and accepted the credible evidence of prosecution witnesses which was sufficient to support the convictions, there was no merit in the renewed application for leave to appeal, and one month of custody time spent pending the renewed application is ordered not to count towards sentence under s83W(1).
