By majority the Court held the 2nd defendant was liable: negligence established because the occupier supplied and permitted use of equipment for an obviously dangerous system, knew or ought to have known the risk, had proximity to the plaintiff who was a lawful visitor, harm was foreseeable and it was fair, just and reasonable to impose liability; therefore the appeal is dismissed and the judgment against the 2nd defendant affirmed (the occupier was a joint tortfeasor in the circumstances).
