The court found the plaintiff had fabricated or materially falsified key elements of the stock claim (notably exaggerated hand-embroidery costs, nonexistent eyelashes and hand-crocheted dresses), failed to produce reliable original records, and therefore committed a fraudulent claim; condition 13 of the policy operated to forfeit all benefits under the policy and the insurer had not waived the right to avoid the policy by its investigatory conduct, accordingly judgment was entered for the defendants.
