The learned magistrate erred in law by treating the prior fine and claimed hardship as automatically barring forfeiture; where the statutory conditions for forfeiture are met the magistrate must not refuse forfeiture merely because it imposes further penalty or hardship; no good reason was shown to deny forfeiture here, therefore vehicle No. BB6891 must be forfeited to the Crown.
