The sentencing magistrate correctly applied established sentencing guidelines, adopted a 22-month starting point for each offence and reduced each sentence to 15 months for the guilty plea; concurrent sentencing was appropriate; family hardship and the appellant's medical complaints do not justify reducing the properly imposed sentence, therefore the appeal is dismissed.

The appellate court allowed the appeal in part, holding that while the Li Chang-li sentencing benchmark for forged identity cards applies, the appellant's longstanding status as a domestic helper, circumstances of terminated employment and personal hardships constituted sufficient mitigation to reduce the sentence on the forged identity card offence from 15 to 12 months; the magistrate's Charge 2 sentence of 3 months was reduced by one third for guilty plea to 2 months with 1 month ordered consecutively, producing a total effective sentence of 13 months imprisonment.

The Court affirmed that the established 15‑month tariff applies to illegal entrants found in possession of forged identity cards and to unlawfully remaining offences; prior unlawful entries or convictions justify enhancement (commonly to 18 months), forged‑ID and unlawfully‑remaining sentences should normally run concurrently absent exceptional features, and appellate review under s83I(2) permits adjustment of all sentences in the proceedings. Applying those principles the Court varied the sentences for the three appellants to totals of 25, 22 and 18 months respectively.

The judge erred in principle by treating concurrency of the two drug-trafficking sentences as a matter of totality rather than by having regard to the overall narcotic content of closely connected offences; on re‑assessment the aggregate sentence was manifestly excessive and required reduction from 5 years to 4 years 6 months, implemented by ordering that only 3 years 6 months of the 4-year sentence on Charge 3 be served consecutively to the 12-month sentence on Charge 1.

The magistrate correctly determined an appropriate overall sentence of 24 months for the related offences, properly applied the principle of totality and fairly deducted the 10 months previously served; the appeal was allowed only to correct the administrative error reversing which term applied to which charge by reallocating the sentences and ordering them to be served concurrently, with convictions otherwise affirmed.

Even if the appellant was a two-way permit holder, producing a forged identity card constitutes use and, under the Court of Appeal authority in Lee Chang Li, attracts a 15-month sentence; moreover courts cannot exercise discretion to follow a previously competing sentencing practice subsequently disapproved by the Court of Appeal, so the 15-month sentence stands and the appeal fails.

Given the prosecution failed to provide sufficient factual particulars to prove the appellant used the forged identity card to seek employment, the court would not treat the offence as one warranting the higher sentencing range; where a defendant is lawfully present, possessed a forged identity card with intent to use it for employment and used it only to gain entry (without proof of use to seek work), an appropriate sentence on a guilty plea is six months imprisonment.

The application for leave to appeal out of time was dismissed because the appellant's guilty plea was unequivocal and supported by the facts he admitted, he did not fall within any category rendering a plea a nullity under the authoritative test from HKSAR v. Wong Chi Yuk, and even if his late assertion of lawful entry were true it would not provide an arguable ground of appeal.

Appeal allowed in part: sentence reduced from 12 months to 6 months because, although the appellant was lawfully present, he purchased a forged identity card in the Mainland before coming and produced it to the police, which amounts to planning and an aggravating act; applying established principles and sentencing ranges, a six-month term is proportionate.
