The Court held that, although the trial judge may have started at slightly high individual tariffs and one sentencing range change post‑dated the offence, the offences formed part of the same organised scheme, the judge gave full credit for the plea and expressly reduced the aggregate; therefore the total sentence of 5 years was not wrong and the application for leave to appeal was refused.
