The court found the Disputed Forms were prima facie forged and filed without the company's authority, that the Plaintiff satisfied s.42(1) and the s.42(4) criteria because the continuing presence of the entries and annotations posed a real risk of material damage to the company (creditworthiness, mortgage and title risks) and the company’s interest in removal outweighed others, and therefore ordered the Disputed Forms and associated annotations to be declared null and void and removed from the Companies Register.
