The Court of Final Appeal held there was insufficient reliable evidence to establish an oral gift of the deceased's beneficial interests in the Good Harvest, Vacha and Hacienda accounts; Good Harvest and Vacha were nominees and one-half of their balances formed part of the deceased's estate; Vivienne was not liable to account for dealings with those accounts during the deceased's lifetime; accordingly the sums in Hacienda and one-half of Good Harvest and Vacha passed under the gift in the deceased's will dated 26 October 2002.
