The court held on the balance of probabilities that the defendant breached certain earlier purchase orders by delivering defective or late goods and was liable for the customer deduction of €62,839.20; however the plaintiff failed to prove binding agreement or timely supply of materials for most of the later purchase orders and so failed to establish liability for the larger claimed losses; the defendant's counterclaim for unpaid manufacturing, material and related charges in the amount of ¥652,661.40 was established on the evidence in part.
