The judge did not miscarry in refusing a permanent stay because the claimed legal professional privilege did not make a fair trial impossible and missing privileged material could be addressed in the trial process; however, certain grounds challenging how the LPP issue and its impact on the applicant’s state of mind and duties were handled (grounds 2,3,4 and a question of law on ground 5) raise reasonably arguable points and leave to appeal on those specific grounds is granted; leave on other grounds and against sentence is refused.
