The court held the plaintiff's causes of action accrued when the 2013 advice was acted upon (contract accrual 4 March 2013; tort accrual 7 March 2013) so the claims were time‑barred; s31 latent damage did not avail the plaintiff; continuing breach and fraud/concealment allegations were inadequately pleaded and implausible; objectively there was no reasonable cause of action against the solicitor who acted on counsel's qualified advice; therefore the claim disclosed no reasonable cause and was an abuse of process and was struck out with costs.
