Because the writ and supporting evidence were properly served, the defendant did not appear, and the pleaded facts established that the funds were obtained by fraud and remain in the defendant's account, the court was entitled to proceed in the defendant's absence and order the respondent bank to pay over the sums under the vesting order to give effect to the plaintiff's entitlement as shown on its statement of claim.
