The Court held the trial judge was entitled to treat 26 days per month as the working average because the appellant had effectively conceded that figure in submissions, and in the absence of any reliable evidence of personal expenses beyond rent the judge was justified in treating the notional 10% savings as the sole evidence of the 'free balance'; the court must not speculate or substitute its own estimation where evidence is lacking. The appeal was dismissed.
