- Court
- Court of Appeal
- Case number
- CACV45/1989
By majority the Court held that s.17A(4)(a) and (b) were properly satisfied on the facts: where a petitioner indisputably has ample assets within the jurisdiction and gives rigorous undertakings effectively preventing transfer or dealing with those assets and undertakes to comply with any order, such an undertaking can be 'satisfactory' under s.17A(4)(b) even if it lacks the outline proposals required in Grigson for impecunious petitioners; accordingly leave to apply to make the decree nisi absolute was properly granted and the order of 20 March 1989 was upheld.
