Sections 204 and 205 of the SFO, when invoked pursuant to section 207(e), meet the Basic Law 'prescribed by law' requirement and are a proportionate means of pursuing legitimate regulatory objectives; the RN Regime is constitutional as drafted and applied in form; the Applicants' systemic challenge fails and the application is dismissed.

The ex parte injunction was discharged because the applicant failed to disclose material communications (emails between the defendant and plaintiff showing the defendant's explanation and that it had made payments) to the ex parte judge; the police freeze and earlier communications from the fraudster were not material for discharge. A re-grant of the injunction was nevertheless permitted and amendment to the account number was allowed.

The court granted the Norwich Pharmacal order because the plaintiff produced cogent and compelling evidence of concerted fraudulent activity, the disclosure of the intended defendant's address would very likely enable the plaintiff to issue and serve proceedings and thus reap substantial benefit, and the narrow request (address(es) only) was not unduly wide; the bank was to be indemnified for costs of compliance.

Because the Commissioner of Inland Revenue's sudden demand and freezing of bank accounts, following police notification, had the effect (or appearance) of frustrating the court's bail order and negating the ability to meet bail, the court exercised its discretion to reduce the cash component of bail from $500,000 to $250,000 while retaining other conditions; bail conditions must not be rendered illusory by external executive measures.
